Canada will become party to the Nairobi Convention on the Removal of Wrecks, 2007 ("the convention") effective 30 July 2019 (by way of agreement dated 1 May, 2019).
This new insurance requirement stipulates that compulsory insurance for wreck removal is required for owners who operate vessels that:
- are 300 gross tonnage and above; and
- are registered in Canada, or that call at ports or terminals in Canada (including inland waterways, the territorial sea and exclusive economic zone).
Furthermore, if you own a vessel that meets these criteria, you must also hold a Wreck Removal Convention Certificate showing proof of insurance.
To apply for a Wreck Removal Convention Certificate(s), you will need to send Transport Canada the following:
- evidence of valid insurance coverage or another form of financial security (usually a "Blue Card" issued by a Protection and Indemnity (P&I) Club or other insurer); and
- a completed application form
A bulletin has been issued by Transport Canada detailing the new insurance requirements for vessels under the convention.
